Terms of Use

These Terms of Use ("Terms") govern your use of the ImageLocate app for iPhone and iPad ("the App"), a product of NAV-INT-LLC ("we", "us", "our"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

1. Licence

The App is licensed, not sold, to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"), supplemented by these Terms. Where the two conflict, the Standard EULA governs to the extent the conflict concerns Apple. The App is a one-time purchase on the App Store, with no subscriptions or in-app purchases, and we grant you a personal, non-transferable licence to use it on Apple devices you own or control, as the Standard EULA's usage rules allow. Payment, Family Sharing and refunds are handled by Apple; you can request a refund at reportaproblem.apple.com.

2. What the App does — and what it can't promise

The App estimates where a photo was taken, and from which floor, by weighing clues in the photo and its metadata. Its answers are estimates with stated confidence, not facts. They can be wrong, sometimes with high confidence, and the App will often decline to answer. Do not rely on the App for navigation, emergencies, legal or evidential purposes, safety decisions, or anything else where a wrong location could cause harm.

Your photos and results stay yours and stay on your device. We do not receive them. You are responsible for the photos you analyse and for how you use the results.

5. Third-party services and data

With online features switched on, the App queries services run by others — Apple Maps, Wikipedia and Wikimedia Commons, OpenStreetMap, Open-Meteo, AWS Terrain Tiles, Open Topo Data and Open-Elevation — as described in the Privacy Policy. Their content is provided by them under their own terms, and we are not responsible for its accuracy or availability. Map data © OpenStreetMap contributors, available under the Open Database License. Wikipedia and Wikimedia Commons content is available under the licences stated on those sites. Weather data by Open-Meteo.com, under CC BY 4.0.

6. Intellectual property

The App, its design, code and content (other than third-party content) belong to NAV-INT-LLC and are protected by law. These Terms give you no rights to our names, logos or trademarks.

7. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP'S ESTIMATES ARE CORRECT OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE. Some jurisdictions do not allow these exclusions, so some may not apply to you.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM RELIANCE ON THE APP'S ESTIMATES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED US$50. Nothing in these Terms limits liability that cannot be limited by law.

9. Apple

These Terms are between you and NAV-INT-LLC, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. To the extent permitted by law, Apple has no warranty obligation for the App, and is not responsible for addressing any claims by you or others relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, consumer-protection claims, or intellectual-property infringement claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Termination

You may stop using the App at any time by deleting it. Your licence ends automatically if you breach these Terms.

11. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. If you are a consumer in the European Economic Area or the United Kingdom, you also keep the protection of the mandatory laws of the country where you live, and may bring proceedings there.

12. Changes to these Terms

We may update these Terms. The new version will be posted here with a new effective date; continuing to use the App after that means you accept it.
